CCTV Privacy Notice

PRIVACY STATEMENT

In compliance with R.A. 10173 or “Data Privacy Act of 2012”, we respect your privacy and the confidentiality of your personal information. This Privacy Notice outlines what personal information we collect and how we use and protect it from collection to disposal.

Personal Data Collected
We may collect from you video recordings and still pictures which feature you if you are in the field of vision of any of our CCTV system. This personal information may include your activities, your face, motor vehicle details and other visual information about you which is recorded on our CCTV system.

Use
We will collect personal information on our CCTV system and use it for the following purposes:
(a) prevention and detection of crime;
(b) evidence in any administrative, civil or criminal legal proceedings;
(c) assisting in investigations;
(d) safety and security and monitoring;
(e) dealing with any queries, complaints or enquiries; and
(f) other security related purposes.

Protection Measures
We take appropriate organizational, physical and technical security measures to protect your personal information and data from loss, misuse, unauthorized access, disclosure, alteration, and destruction, considering the risks involved in the processing and the nature of the personal information and data.

Sharing
We share your personal information with the following parties:
(a) The police and other law enforcement agencies: to carry out policing, assist investigations,
trace missing people and investigate alleged criminal activities;
(b) The security services: where relevant for matters of national security;
(c) People who have been injured, attacked or had property damaged or stolen and their
Insurance providers: to assist them with any criminal or civil investigations or legal
proceedings;
(d) People who have been involved in road traffic accidents and their insurance providers: to
assist with insurance claims, legal claims and investigations;
(e) Private and other investigators: to aid their investigations; and
(f) Any relevant authorities and regulators: where we are required to do so by law or to assist
with their investigations or initiatives.

We do not disclose personal information to anyone else except as set out above unless we have your consent or we are legally obliged to do so.

Storage, Retention and Disposal
Footage recorded by CCTV cameras shall be stored in a secured area and restricted to authorized personnel only. We will keep your personal information for up to approximately 30 days after the recording was made. After this time the recording stored on the hard drive of our CCTV system will usually be overwritten. However, if we receive a request about a particular recording on our CCTV, we will generally then retain that part of the recording until it is no longer required. This period can vary as it will depend upon the circumstances of the particular case, but for criminal or civil legal proceedings, this could mean that the personal information is retained until after the legal case and any appeals have been concluded. As soon as it is no longer needed, we will then delete the personal information.

Rights of the Data Subject
• You have the right to be informed that your personal data will be, are being, or were, collected and processed.
• You have the right to access or obtain confirmation on whether or not your data is being processed by the organization or obtain a copy of any information relating to you that we have on our manual filing system.
• You have the right to object to the collection and processing of your personal information for direct marketing, profiling, or in cases of automated processing. You can also object to the processing of your personal data where such processing is based on consent or legitimate interest.
• You have the right to suspend, withdraw or order the blocking, removal or destruction of your personal data upon discovery and substantial proof of any of the following:

  1. The personal data is:
    a) incomplete, outdated, false, or unlawfully obtained;
    b) used for an unauthorized purpose;
    c) no longer necessary for the purpose/s for which they were collected; or
    d) concerns private information that is prejudicial to you, unless justified by freedom of speech, of expression, or of the press, or otherwise authorized;
  2. You object to the processing, and there are no other applicable lawful criteria for processing;
  3. The processing is unlawful; or
  4. The PIC or PIP violated your rights as data subject.

• You have the right to dispute the inaccuracy or error in your personal data and have it corrected by the personal information controller (PIC) within a reasonable period of time.
• You have the right to data portability which allows you to obtain and electronically move, copy or transfer your data in a secure manner, for further use.
• You have a right to file a complaint with the National Privacy Commission if you feel that your personal information has been misused, maliciously disclosed, improperly disposed, or that any of your data privacy rights have been violated.
• You may claim compensation if you suffered damages due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal data.
